NHAI Road widening and occupied my property

I had a 50 x 70 plot abutting main road ( National Highway ). The NHAI acquired about 2000 sft of the property providing meagre compensation. Now I have 2 doubts 1. How can I enhance the compensation? 2. There has been a small deviation of 2%. Is this allowable as per NHAI rules?

To increase compensation, you need to challenge payment of compensation by NHAI authorities in High court and seek enhancement. No deviation is allowed as per NHAI Rules. If NHAI has acquired your plot, you can only challenge quantum of compensation and not the act of acquisition.

You will have to file a Land Acquisition case before the tribunal ( if your are in Karnataka), otherwise civil court has got jurisdiction to try the Land Acquisition cases. Before that you will have to file an application before the concerned authoritty, which will be treated as miscelleneous case in the court.
