Neighbors toilet leaks from the roof of our toilet.

We have notified for long about the seapage of our upstairs neighbour toilet from the roof of our toilet and requested many times to fix it. He makes excuses every time but had not repaired it yet. Please let me know the legal recourse. Can I file an FIR, ask for damages under what section/act. What are other legal remedies available. Please help.

You can file a civil case for maintenance of the sepage against the person who lived above to you. You can also ask for damage . Once court will order he will have to repair the damaged toilet.

Yes we can go ahead and file a suit for damages.Therefore a suit seeking relief for past /present and future damages can be filed in the competent court .Its a civil suit which within itself lays the provisions for the recovery of losses.Therefore other legal remedies can also be opted.
