Medical reservation in Tamil nadu is 85% is against NEET what to do

30-Jun-2023 (In Civil Law)
My daughter studied 12th in CBSE. As per Supreme court advise, all medical admission should be NEET based. But in Tamilnadu, the government allocating the seat to state board based student as 85%, rest 15% will be allocated to CBSE/other students. This is against supreme court order and similar order was rejected by Gujarat High court earlier. Could you please help, can i file the petition in supreme court against TN govt order and supreme court to advise TN govt to follow all medical admission should be NEET based please?

Yes u can approach supreme court challenging the TN Govt order. The very same plea was rejected by the Madras High Court yesterday. The Writ petition was filed before the Madras HC challenging the TN govt order reserving 85 percent seats in MBBS and BDS courses for the state board students and 15 % seat to the other boards. It was submitted before HC that the seat allotment should based on the NEET exam result and not by the state or central board results and further submitted that the merits list should be prefarred from the NEET result and those 85% should be fulfilled by the students who have studied in schools situated in TN but Madras High Court ordered notice to the respondents. But the SC's observations very clear that the seats should be fulfiled based upon the NEET results and not by the state board or central board results. Therefore it is a fit case to approach the SC.

You can file a case before the high court against the Tamil Nadu Government's' action against the Supreme Court's ' order.you can place your arguments before the high court itself.so no need to file the case in the Supreme Court directly.
