Legal Rights against owner of property?

Dear all learned advocates I would like to ask a question about my property I purchased a house of which I have given the earnest money and part payment no. 1 but due to some reason I was not able to fulfill the deal it's been six months now I m able to fulfill the deal but owner is saying that he will not give me the home nd neither my money and along this all I discovered that at the time of agreement this owner was not the real owner of the property he become owner after 7 months of our agreement what should I do?
You can file a case under section 43 of transfer of property act it deals with transfer by unauthorised person who subsequently acquires interest In property transferred . You have two options if you want to buy the property pay the balance otherwise ask for repayment of your money along with interest
