Kharab land site is taken by someone how to get it back

09-May-2023 (In Civil Law)
We purchased a Kharab -'A' site measuring 40 x 160 feet in 1995 in Bangalore not knowing that it was kharab. We are paying property tax for the site every year and EC has our names. We have not yet made the khata for the site. Now suddenly we find that without our knowledge some surrounding layout people have built a Mosque 40 x 40 feet on our land within last year. Two scrap selling sheds have also been built. The RTC (Pani) shows that the land is A-kharab. Our names are not mentioned in the RTC. Please guide us on how to proceed legally to claim our site back.

You have two options. Firstly you may approach the Assistant Commissioner for entry. Normally they resist and ask you to go to panchayat/bbmp. Secondly, you may file a suit and get injunction order against the encroaches on the available documents.
