Is video recording of association meeting illegal do i need permission

Hi, Can you please tell me if Video recording of Association Meeting illegal. Do i need to take permission from Association Office bearers to video record the meeting. If they don't allow me to do so, can i still do it. Can they bar me from Attending Association Meeting, as i am insisting on video recording of Association Meeting.

The law regarding recording of conversation by one of the participants is not clear. The other party who has not given consent can bring up privacy issue as its guaranteed under Article 21 of the Indian Constitution. Also under section 66E of IT Act. However, there is no law that expressly bars recording of conversations.
There are two situations:
1) if at least one party has given consent, recording is legal
2) if none have given consent then the court usually weighs the privacy issues against the public interest and if the public interest outweighs the other, then its legal

Therefore, while the other party can always claim that their privacy rights were violated. The chances of such claims being accepted are less as there is no law that exclusively bars recording of conversations either.

Under Section 65B of Indian Evidence Act, recorded conversations are admissible as evidence.

Association meeting is not a public event. There is no free license to videograph the event. If the Association at its meeting pass a resolution that its meeting be video recorded, then it is ok. Otherwise not. The Association cannot as a punishment bar you from attending the association meeting. At the best, they issue a notice to explain why you were recording the proceedings. Suitable reply need to be given.
