In Case Of Remand to rent tribunal
19-Apr-2023 (In Civil Law)
Respected Sir/Madam. Rent tribunal and Applleant Court ne Landlord Ke Favour me 3 Point Per Degree di 1) Bonafide 2) Deny of Title 3) Default. Par Rajasthan High Court Jaipur ne 1) Bonafide ke case me Rent tribunal ko remand kar diya and case disposed kar diya. Kya 1 Point per remand hone se 2 point nhi rahe. Is Case me kya karna chahiye Please help.
If the matter is remanded on a specific point than tribunal has to decide only that point..other points will sustain as it is...but the high court set aside the judgment therefore tribunal will hear the case again on the bonafide necessity
my dear friend , contest your case in rent tribunal on the ground reasonably and bona fide requirement
this is the main moot point of the case .

If the Hon'ble HIgh Court had reminded the matter to Rent Tribunal only on one point, it is obvious that the Hon'ble HIgh Court had upheld the decision of the Rent Tribunal on remaining two points and the same are now two of the purview of the remand case of Rent Tribunal and if you wish so you can challenge the decision of the Hon'ble High court in next higher court i.e. Divisional Bench or Supreme Court whereas the REnt Tribunal will only deal with aspect of bonfide, which should be effectively contested on your behalf.
