I want to get legal heir certificate. How to proceed ? Advise please.

Want to get legal heir cert. I am a NRI and my sisters and brother are in chennai. My parents are no more. Our parents property is in chennai and we want to dispose off this for which we need to apply for the legal heir cert. What is the fees, How long does it take and what are the documents needed Are there any agents in chennai whom I can trust to get it as early as possible,

Generally, people go in for Legal Heir certificate issued by Taluk office. The Revenue Department officials get declaration and affidavit from the applicant, from other legal heirs and issue the certificate. It has no legal sanctity. But practically it is convenient and invariably people rely upon this certificate. No fee is prescribed. We have to apply and closely follow it up.

When you parents expired? Whether you have applied before for the certificate? If within 2 years you can apply to concerned Tahsildar and get. Otherwise we have to get from court direction and get the same. If you need any help pls contact me .

TO obtain legal heir certificate you .

you have to be very clear regarding in whose name the said property stands. If the property is in both the names of your father and mother you haves to produce the death certificates. or property is in the name of either of the one then you have to obtain death certificate. Then you have to obtain LEGAL HEIR CERTIFICATE.

One of your brothers or sisters can apply for the legal heirship certificate. The actual fees is only a few hundred rupees but you may have to spend a lot more if you want the work done faster. It will take about 10-15 days depending upon the office where you apply. My office can get this work done as we have a person to take care of such work.

The thasildhar where the death place of your father situated is the competent authority to issue legal heirship certificate and normally collector is also added as defendant along with thasildhar and normally you file suit for declaration declaring that you and your siblings are the legal heirs of deceased father and when your father died only before three years means normally thasildhar issue legal heirship certificate after proper enquiry through village administrative officer and revenue officer and after the expiration of three years from the death of your father means thasildhar issue nonavailability certificate and advised you to get declaration from civil court and xerox copy of death certificate of your father and your mother and non availability certificate and Xerox copy of identity proofs of you and your siblings are added as plaint documents and normally this suit takes 1 year to 2 years to complete after due compliance of paper publication tomm tom batta and general notice
