How to reopen the case if decision was Ex parte

Due to some personal reasons we miss aur court hearings and aur case in ex parte can i do something bcz we have no solid reason for reopen file is in record room

Dear Sir,

You can have your case re-opened by filing an application in the appropriate court and seek the relief of setting aside the order of ex-parte. Further, you have to request the court to decide your case on merits.

Hi, in the narrow conspectus of the facts shared by you it prima facie appears that due to the negligence of yourself or your lawyer you missed a court hearing date. In that view you will have to file an application for recalling of the exparte order disclosing sufficient reason to condone the negligence.

To set aside ex partie decree need to move appropriate application but since you saying that file is in record room seems like that you have exceed the time limitations to file the same .Therefore need to disclose the correct time period and the case details for accurate reply thanks.

In such cases the only recourse which you have is to file a revision. However it totally depends on the facts of the case, as to whether it was a criminal or civil proceeding, and differ case to case. To opine this query, full disclosure of facts is needed.
