How to get ancestral property share when cheated by uncle?

We have a ancestral property where it should be equally divided among 3 of them- my dad, elder brother and sister. But elder brother emotionally black mailed and took over the whole property. Now he is torturing... What is the legal procedures we have to take
You will have to file a partition suit in competent civil court having jurisdiction over your locality claiming your father's share in the property.Under Hindu succession act Can get equal share by court in partition suit,..!
