How to file accident case against Ola

I was travelling from Varanasi to Patna in Ola Outstation on 07th June 2017. The car met with accidents 3 times, first two were minor and last one was major. The car plunged into a canal and resulted in injuries of me and my Dad. My 66 yr old Dad got multiple fractures on his backbone, he has been suggested 4 months bed rest. Not only this Ola failed to provide support on Road and i had to travel from a village to Patna by taking lift from villagers and paying lot of money. No FIR was registered as no police came to the spot. And considering the injury and heart condition of my Dad i didn't waste any time there in the remote village. I think this case comes under Motor Vehicles Act. I am currently in my hometown . Any legal help will be very helpful.

As per my views you may take the path of consumer forum where the result will be fast and beneficial for you and your father instead of going to the Motor Vehicles Act. As the same will time consuming and may pronounce small amount of compensation . Call is yours take the suitable advise of the area practising counsel's without wasting of any further time.

Dear client,
As per the details provided by you I would suggest that you should first of all file a complaint before the concerned police station annexing all medical documents and write a letter to the concerned person of ola demanding compensation from them. And in the event of their failure to do say you can file case before consumer court.

It is late but not too late.Still FIR can be lodged U/S 154(1)of Cr P C.In case of refusal on the part of the local police Station to accept the same, send the same to SP of that area through post U/S 154(3) Cr P C.Documents related to all medical treatment must be enclosed.Thereafter, claim under the M V Act is to be filed for compensation purpose . Keep OLA on the loop . Being a commercial cab, the same must have appropriate insurance coverage.For further instructions contract lawRato.

Yes it is came under Motor Accident Claim Tribunal. you should contact with an Advocate who handle MACC Case. He will give you suggession if you get benifit under Section 140 of MACC or not. Though you stated that no FIR was lodged.
