How to deal with threats of demolishing property

09-Jun-2023 (In Civil Law)
Hi, 1)The municipality in my area demolished number of houses in my area which were encroaching govt land and also demolished my property which was totally legal (I have a Patta and proper registration papers of the area) without serving any notice. The reason cited was broadening of roads. Is this legal? 2) I did buy another plot of which some area was gifted to municipality and construction was done after 20 yrs municipality claims that my construction is illegal and I am encroaching their land. I did show my papers to the Sub collector cum executive officer and he found papers to be accurate and no illegality. But the municipality keeps threatening me that they will demolish my construction within days. What can I do?

Under Article 226&227 you can file WP in HighCourt against Municipality, Collector and Devlopment Authority.First get an interim stay and then defend your case in the basis of ROR documents. If every thing is right you can win

Don't worry in this case you file U/S144 case in DCP Court.DCP direct the municipality to stop the demolished of house and at the same time you also registered a FIR against municipality. This document will help you in 144 case.

Whether the record of right (R.O.R) is in your name or in the name of municipality. If is in the name of municipality then file a case for correction of R.O.R then approach Honorable high court for stay or contact for better suggestions
