How to appeal against an Injunction order
13-Feb-2023 (In Civil Law)
junior division court has given order for injunction removal. Basis it, we have started constructing our house. Other party has approached SDEM and got order u/ sec 144 twice. Not sure under what ground it is being issued ex-parte ignoring the fact matter is pending with honbl court. Police station has verbally asked us to submit latest injunction update else stop work. what should we do to continue the work. Thx
In such a case the civil court order is of precedence over SDEM. You may apply before a higher court for order. proper suggestion may be given after proper verification of the papers. the matter needs to be filed within a stipulated period for showing urgency as that is the essence of any order of injunction.
