How can I claim share in my grandfathers property

07-Apr-2023 (In Civil Law)
My grandfather has two children, one is my father passed away in the year 2001. My father gave my grandfathers property documents to our relative to change title from my grandfathers name to my fathers name, but he didn't do that instead he sub-divide the plots (total 4 plots) and got the grandchildren to sign the papers. I didn't signed any papers. Now I want to have my share, Please advice

You can file the suit for partition to get your share in your grandfather property. When the property being your grandfather property you have a right to seek partition. If any alienation take place to the said property without your consent will not confine your right.

Since your father already died and property stands in the name of your deceased grand mother you have right to step into shoes of your father to get your grand father property and your father is entitled to 1/2 share in your grand father property and if you are only one son to your father and your mother is alive means you get 1/4 share but your mother already passed away you get 1/2 share in grand father property and if you have full blooded brother or sister means that they also get equal share along with you as per the hindu succession act provided that you are hindu.
