Hindu-christian marriage with customs under special marriage act

22-Jul-2023 (In Civil Law)
Can me (a Hindu Girl from Gujarat) and my boyfriend (A Malayali Christian Jacobite Boy) marry without conversion with both the customs and legally get married under Special Marriage Act for the certificate? My Parents want to do 'Kanyadan' which is believed to be a boon for a girl's parents. Can he marry me without converting to Hindu by Hindu Customs? His Parents want the marriage to happen with all the customs in their church (for which they are saying I will have to convert to Christianity and undergo Baptism). Can I marry him without converting into Christianity according to Christianity customs. We discussed about the kids and I am ok with the kids adopting Christianity. (However they are saying that I need to convert to Christianity for our kids to undergo baptism). Can we marry with both the customs for our parents happiness and legally marry under Special Marriage Act.? What are the consequences later on?

The Special Marriage Act, 1954 is an Act of the Parliament of India enacted to provide a special form of marriage for the people of India and all Indian nationals in foreign countries, irrespective of the religion or faith followed by either party. The Act originated from a piece of legislation proposed during the late 19th century.

You can marry under the Special Marriage Act without the conversion of the religion. Thereafter ,you can follow your own religion as you decided to go on.the marriage ceremonies also will not affect in any manner.

Under Special Marriage Act both of you can retain your religion. But by seeing your mail one thing is pretty clear that the bridegroom side is very stubborn for converting you to Christianity. To be a Christian baptism is compulsory. Once you are converted then for all practical purposes you are not a Hindu and in the event of any dispute between you, the remedy for you is only under the Christian Act. Under Christian Act, divorce is very cumbersome and time consuming. The choice is yours.
