Have leave and license cheated by owner how to get money back

I stay in mumbai.I made an leave and license agreement for a flat and it was on terms of heavy deposit rental scheme in which it stated that i gave a cheque of 15 lakh INR to the owner of the house for agreement of 22 months and till that period i would stay in the house. I would vaccant the flat after these period and when the 15 lakh INR is returned. Now the case is the owner had a loan taken by XX financial services and he did a fraud by not informing about these situation. Bank have sent few notices .I have just sent an informative notice to bank through a private post stating the situation, sent the copy to owner and also to police station (attached agreement).Bank have published notice in newspaper about the auction and all, given extension period to owner. Bank have said me that along with their amount they also will settle my amount. But they have not given me anything in writing. So should i go for a stay in the court on these proceedings or send another notice or file a case

If you have paid deposit and lcensce fee then you have record of it he did not refund your deposit he has no evidence of refund .
