Got a legal notice in name of my father but he is in defense services

Sir My fathers has 3 big brothers and they have done case on each other due to property. My father is the smallest one and he is in defence service . Yesterday we got notice from court in name of my father to appear in court but we live in rajasthan and my fathers posting is in Gujarat as he is in Military so what should do . The postman told that it will be only in favour of ther person the name written on the notice but my father does not live here. The post man told that the notice will be returned in 5-6 days. Sir is there any problem . I Think Sir the notice must be in the favour of my father in his posting area address. Can u help me sir ..

my dear friend , take notice on behalf of your father because if you will refuse to take this it is also consider as notice served .
then you tell your father about the notice , he will engage a lawyer to represent him in court .

This is not a big issue.
A representative advocate or authorized legal representative may appear on behalf of your father. Your father may appoint a representative by issuing power of attorney and then may appear for the same case. If the notice accepted you or your father and could not appear at the time of court say. Your father may present "Hajari Mafi" for particular date through your advocate.

आपके पिता के नाम से पंजीक़त डाक से नोटिस आया है तो आप डाकिये से नोट अंकित करावें कि इस पते पर नहीं है अपितु फलां स्थाेन पर नौकरी करते हैं, अत वापिस,
आप चाहे तो अपने पिता से अपने नाम मुख्यास र नामा बनवाकर उनकी ओर से न्याियालय में पेश होकर पैरवी कर सकते हैं लेकिन आपको वरवक्तत बयान उनकी स्ववयं की उपस्थिति आवश्याक होगी, आपको उक्तो नोटिस के लिफाफा पर प्रकरण के संख्यां क व प्रकरण का नाम तथा तारीख पेशी व न्या यालय का नाम मिल जावेगा जिसके माध्यरम से आप न्याायालय में जाकर प्रकरण के बारे में जानकारी हासिल कर सकते हैं तथा अपने पिता का वकालतनामा हस्तावक्षर करवाकर उनकी ओर से वकील खडा कर सकते हैं

dear in fact, when your father is in defense service there is no chance that he will remain present all the time to receive notice and when it is a matter post man either can write that person was not available or he can serve it to you , you being his son can take notice on behalf of your father stating the reason on notice itself or you can give it in writing to post office that your father is posted outside and his address is so and so and a notice can be send over there , as such there would not be any problem un till or unless a notice is served. you have not mentioned that notice is pertaining to which matter and otherwise also if it comes to your knowledge the notice is from any hon'ble court you can approach to that court and by giving a present letter to court any advocate from your father's side can get notice copy.
