For recovery of Stamp Duty, Can I file a Civil Suit OR writ petition in High Court against State Authority for not filing appeal u/s 47A(4) Indian Stamp Act to recover evasion of stamp duty. Facts : In 2007, Suits for partition of ancestral properties filed between plaintiff BS Aggarwal and defendant Om Prakash (brothers). That in out of court settlement in 2014, it was mutually agreed that plaintiff’s share will be 23/40 share in urban agriculture land having two side roads in exchange to defendant of 17/40 share in urban agriculture land other properties and written affidavits were executed and exchanged by plaintiff and defendant. That it was further agreed that defendant with other persons will purchase plaintiff’s share for Rs.2.80cr to put an end to all disputes. Accordingly plaintiff executed an Agreement to Sell dt. 15.01.2014 for Rs.2.80cr but sale deed was registered on 19.6.14 for 1.5cr.Plaintiff's complaint of stamp duty evasion to SubRegistrar u/s 47A was dismissed
