FIR lodged 1 year back no action taken by police how to proceed

05-Jul-2023 (In Civil Law)
A FIR has been lodged in police station (Madhya Pradesh) but no action has been taken till now. It's been 1 year enough time to start a 'process' or the case but the Inspector is saying 'we are gathering call details'... How long will it take? How much more should I wait? What should I do so that Police start investigation? Is there any process to RTI against police's delay to my FIR? Or can I go to court? What is the process of taking the case to the court?

I have already given the answer to this enquiry only one part of the enquiry missed by me to give the solution which is that you can take the information about your case by RTI (right to information) and police is bound to give you all information about your case.

I hope this advice will help you to understand and face the problem.

You should file a private complaint before the magistrate concerned asking for a direction to the police for investigation. The judicial magistrate has the power to proceed upon you complaint even though there is already an FIR.

YOU MAY prefer a Writ Petition under Article 226 of the Constitution of India against inaction on the part of the respondent authorities in not taking any action against the accused persons before the Hon’ble High Court of Madhya Pradesh Principal Seat at Jabalpur.
