Filing a case against department of police

Want to file a case against department of police for delaying a DE for 24 years without any decision against my father who took unauthorized leave of 4years and 7 months after 14 years of his duty. The department has accepted that the department enquiry is still pending after 24 years and has asked him to join back for last two months before his retirement. Now department is not ready to pay him his dues for all these years that he lost because of indecision of the department and is trying to shoo him off without any benefit. How do I file the case against the department?

although it seems that injustice has been done to you, yet in order to get justice you need to approach the appropriate court to seek justiceif you want to challange the act of the authority you need to meet lawyer at high court

You need to file a writ before the High court against the department. You better consult a lawyer with all documents. He ought to have been paid subsistence allowance by the department if he was put under suspension. But claiming salary for all those years would be little tough as there is inordinate delay in approaching the Court. Meet a lawyer.

You shall have to institute a writ petition in the high Court against the department and union of india. Engage an Advocate who is well versed in connection to service matters. You shall definitely get relief within a year time or two at max.
