fees refund case from college. What are my legal options ?

"As per recent order of honourable suprem court that education is not commodity,are not service providers, students are also not a consumer .(So can we file case in civil court regarding fees refund from college on points of cheating,lack of facility, unfair trade practice.)
If you have documentary evidences to substantiate your contention that the education institution has cheated you or adopted unfair trade practices, in my considered opinion you can initiate criminal proceedings against them or action for its de- recognition before the competent authority.
If you are only inclined to get your fee refunded on the ground of lack of facility, you may file civil suit if there is provision for it under the Rules of admission or prospectus issued by the educational institution.
