Father's Name correction in CBSE Class 10th Marksheet and Certificate

My name in my daughter's CBSE class 10th mark sheet and certificate is incomplete. Since it matches with school records, CBSE is asking for court order for name change. Please advise, if you can handle this.

RULE 69.1 CHANGES IN BOARD’S CERTIFICATE – CHANGES AND CORRECTIONS IN NAME
AMENDED RULE 69.1(ii): Application for correction in name/surname will be considered only within two years of the date of declaration of result provided the application
of the candidate is forwarded with the following documents:
(a) Admission form(s) filled in by the parents at the time of admission
(b) The School Leaving Certificate of the previous school submitted by the parents of the candidate at the time of admission.
(c) Portion of the page of admission and withdrawal register of the school where the entry has been made in respect of the candidate.

If it is the parent's name that needs to be changed, a court order is usually not necessary. If they still insist, here is the procedure for name change.

Name Change Procedure


STEP 1. Affidavit of Change of Name:

For the Name Change Procedure, first you need to visit a Notary in the District Court of your City. You should ask him to make an Affidavit for Name Change. This Affidavit should be on a stamp paper of Rs.10 or Rs. 20. The details you must mention in the Affidavit are your Previous Name, Current Name, Your Complete Address, Reason for Change of Name.

STEP 2. Newspaper Publication:

Get your Change of Name published in two Local Leading Newspapers daily, one in English another vernacular. Remember to collect at least 10 copies of both Newspapers. These may also be helpful for any other documents in future.

The Newspaper Publication must include the following details :
Your Previous Name, Your Current Name (Changed Name), Husband’s Name & Date of Marriage (In Case of Married Women), Current Address, Date of Affidavit, Name of Notary.

STEP 3. Publication in Gazette of India:

You need to send a few documents, in an envelope, to the concerned authority, at the following address for example — Controller of Publication, Department of Publication, Civil Lines, Delhi-54

The Documents to be kept in the envelope to the Controller of Publication are:-

—Request/ Forwarding Letter: This letter shall also list out all the documents enclosed within the Envelope.

—Specimen for Change of Name (Hard Copy): Take a printout of the Name Change Specimen. It should have the signature of applicant and two witnesses.

—Original Affidavit: Affidavit for Change of Name.

—Original Advertisement: The Newspaper Publication in Original.

—Specimen for Change of Name (Soft Copy): Copy the Specimen File (MS Word File) of Change of Name in a CD (Compact Disc).

—A Postal Order/ Demand Draft of Rs.1000 Rs.1100 in the name of Controller of Publication, Department of Publication, Civil Lines, Delhi-54. You will get 4 copies of Gazette Notification in this amount. Please note that the amount of Demand Draft may be increased from 31/03/2017.

—Two photographs duly attested by a Gazetted Officer pasted on a plain piece of paper with your New Name typed on it.

—A certificate duly signed by the applicant declaring that the contents of hard copy and soft copy are similar.

—An Undertaking duly signed by the applicant which shows his/her old and new name with complete details of father’s / husband’s name with full residential address declaring that the facts stated therein are true & correct to the best of his/her knowledge and belief.

—For individuals working with Central Government, they will be required to submit Deed for change of name in accordance with the Ministry of Home Affairs OM. No. 190016 /1/87-Estt. dated 12th March, 1987.

—In case of Indians living abroad, he / she will submit deed duly attested by the respective Indian Embassy / Indian High Commission, in original to this Department.

—Applicant should also submit a self attested Photo ID proof. Only the applications either submitted personally or sent by Post / Courier will be entertained.

Hi, You need to get decree after filing an affidavit along with petition for the name change. There could be minimum 3 court hearings and at least a week time(including publication) to get gazette notification for the name change. You may approach me, In case if you do not find any competent lawyer in your locality for the same.

As per the regulation passed by the Government of Karnataka if anybody intends to change their name, father name or age they have to obtain decree from the competent court by seeking declaration to that effect. In your case since your daughter has appeared for 10th standard you have to obtain decree from the court.

you send letter to school authority to correct the mistake from their side if you are given proper details to the school. other wise you have to file declaration suit before the court and get the things clear
