Father filed case under senior citizen welfare & maintenance act

30-Mar-2023 (In Civil Law)
My Father filed a case of Sr Citizen Welfare and Maintenance Act in Jan 2017 and recvd order for cancellation of Gift deed made to me in year 2008-2009 was passed in March 2017. No Maintenance has been ordered. I only got a chance for one hearing and i hardly spoke to the Assistant commissioner nor submitted any documents as i was unaware. He is 62 years now and at the time of Gift deed he was not a senior citizen. He is a pensioner retired from Govt service and recieving 25000 and above this I was also paying him 5000 as a gratitude in cash but after he filed a case started to pay the same by cheque. His intention were clear to give the property to his daughter who is well settled. I have already spent building a house on 2nd floor where he resides in 1st flr and have clrd housing loan which was in his name for the same property and his personnel commitements, I have taken care of him monetarily and physically during hospitalization and spent all my whole and soul. Please advise!

It appears to me that the Forum constituted under the Sr Citizen Welfare and Maintenance Act in Jan 2017 has acted beyond the scope of the power conferred on them. As such consult an advocate and have his advise and prefer the appeal if appeal is not allowed under the Sr Citizen Welfare and Maintenance Act in Jan 2017, question and challenge the action of the Forum invoking Article 226 & 227 of the Constitution of India. Your are not without remedy. Good Luck.
