Educational Fraud college did not provide accredited degree

Hello, My name is Ajay Ch, from Hyderabad. I had been cheated by our college (Visakhapatnam, Andhra Pradesh, India) by giving an unaccredited university degree certificate between 2003-2007. I lost two jobs from MNC companies like Accenture & Dell only because of an unaccredited university (Almeda University,USA) certification. That certificate is useless in any aspect. I spent almost 4-5 lacks to complete my graduation (4years) and I am struggling a lot only because of that useless certificate. Now I want to raise a complaint and sue the management and demand the compensation of my 13years of my life. Please provide me the details.

Dear Ajay

Almeda University is a non-accredited institution not affiliated with any university. Their degrees neither recognized by any university in US for higher education nor accepted for any job. As far as I know they are ceased operations couple of years back. There are many criminal cases filed on them in US and still pending.

Coming to your situation, there are many unanswered questions.

1. Did the college promised you accredited degree. If yes, do you have anything in writing from them?
2. Did they provide you any broacher or pamphlet which shows Almeda University is accredited University?

If you believe they have charged you 4-5 lakhs fraudulently, then you must prove it in the court of law that the cheating / fraud was premeditated. If you have enough evidence to prove that then you can file a criminal complaint in police station and send a copy to your local Superintendent of Police.

They can be charged with Section 415 of IPC cheating and Section 421 – 425 of IPC based on facts. I advise you to retain a competent advocate and send them a legal notice with all the facts. Hopefully you will be able to get your fees back with interest. Best of luck.

Before taking any legal action against the management, approach them and explain them the problems you are facing and ask them to settle the matter and refund the amount you incurred and threaten politely of taking legal action against them if they don't settle the same.If the management is not ready to assist you, send a legal notice to the college through a lawyer and demand refund and even after sending a legal notice, they are not settling the matter, file a consumer complaint with your jurisdictional consumer forum. Please note that a student is a Consumer within the meaning of Consumer Protection Act, 1986 since he pays fee to the institute. In various judgments it has been held that educational services comes within the definition of ‘service’ as defined under section 2(1)(o) of the Consumer Protection Act, 1986 (Ravinder Singh Vs. Maharashi Dayanand University (iii) (1997 CJ) 36l. National Commission) Also see Bhupesh Khurana & Ors. Vs. Vishawa Buddha Parishad & Ors II(2001) CPJ 74 (NC).
