Delay in possession by builder

May builder delayed the construction and hand over of the apartment by almost 2 years from the agreed date, and refused to pay the consequent delayed payment charges also. How can I enforce my rights under the contract ?

Hello,
If the construction contract contains a delay penalty that is payable by the builder for delayed delivery, the builder would be liable for the payment for the same. You may issue a legal notice calling upon the builder to make the payments, and if the builder fails to make the payments even after that, initiate legal proceedings for the recovery of the penalty.

file a complaint before the Consumer protection act seeking relief of handing over the possession of the property under agreement. the sale agreement copy is required for filing the complaint before the consumer forum, which will be disposed off expeditiously at the earliest possible time compare to the civil court.

You can get a legal notice issued to the builder giving a time before which he should make good the promise under the agreement. Upon his inaction or refusal you can approach either civil court or consumer forum and file a case.

you should file petition for compensation for delay possession till the date of completion certificate. you can file petition before concern district consumer forum or in RERA Court. you can call me without any hesitation for further information and clarification.

Well, you can file a case in RERA to seek compensation and interest until you get the project or you can withdraw from the project by seeking Refund of the payment made by you to purchase property along with interest, litigation cost + compensation.
