This is a civil wrong it is wrong and illegal to harm any person or body which has occurred in or during a process which was not done with due care or in other words negligent way of working has caused damag. In english common law there is provision of liability similarly in indian law there is provision to sue a person for damages which has occured due to damage caused by action of any private or governmental agency for that first of all you need to give legal notices to all concerned and after that you can bring a suit against parties responsible and accountable for the same.

The contractor was working either on behalf of municipal corporation or development authority. I advice you to file representation seeking payment of damages incurred by you to the concerned government body whoever handed over the work of road construction to the contractor. Legal recourse may also be taken by filing suit for recovery, if your representation is not acted upon.
