Court granted order but now revoking as the opponent mentally unstable

I had court order in favour of me before 3 years.but now I get notice from court mentioning my opponent mentally disorder that time when the order was out... Previous 2 year I sold the part of property somewhere...So what should I do...

just give a legal replt to the aaid notice. since at time there was no pleqdeing of ur opponent as mentally ill so after 3 years they cannot take the defence of that. so you too reply the said notixe from an advocate and contest the same.

Before dealing with your question it is necessary to know that whether the order passed by the Ld. Court was ex-parte or not. If it is exparte they hopefully your opponent filed an application for setting aside the same. In that case pls contest. Before any further advise it is necessary to go through the notice and application served on you from the Ld. Court.

MY OPINION THAT i have read you matter,but i think that if you have received any notice you received for court mentioning from opposite side you should have to face the court, it is very important that what is the new cause of action which you have to face.

It is a very difficult situation for you my dear. Look for your version, it is easily revealed that Order was passed on Ex party. And after passing the Order the Defendant appear and pray before the Appellate Court to Revision the Order on the ground that at the time of passing the order he was an mentally person and as a result of which he did not contest the same. Here the Law does not prejudice any person. Therefore, better to contest the matter. If he fails to prove his mentally condition, then the Order did not set aside. And your the then sold process will not hampered.

Sir, first I have to see, what type of order it is. Which court has passed that order. Only then can i advice what needs to be done.
