Contractor fraud as he is not fulfilling contract requirements

i had given contract of my house with material and agreement was done b/w me and contractor who had made contract agreement on his firm name . at initial stage for 2 -3 months his work was satisfactory after that he stopped visiting site and sending insufficient and untrained laborers and used to collect cash only. his work quality degraded to poor quality. after that i sent cancellation of agreement to him. i also checked out and found that his company is not registered in commercial tax deptt. through RTI . what i should do now.

Was there a written agreement or only oral? Unless I see the agreement it will be difficult to answer the question. How much money have you already paid him? How much of your house is left? It would be best if you can mail the agreement.

File a complaint under the consumer dispute redressal forum/commission having jurisdiction to try and entertain the said matter, keeping in mind the pecuniary jurisdiction of the complaint.
Kindly elaborate on the fact that you 'sent a cancellation of agreement', further what happened.

The Latin maxim ‘Ubi jus, ibi remedium’ denotes where there is a right, there is a remedy. So you have th right to go for a suit.

The remedies for breach of contract are:

1. Suit for damages or compensation

2. Suit for specific performance

3. Suit for injunction

4. Suit for rescission

5. Punitive damages

The law on this issue is dealt with in two statues viz., The Specific Relief Act, 1963 and The Indian Contract Act, 1872.
