Company Not Paying Outstanding Salary After Resignation

I was with my few friends working for a company name estingo network private limited situated in nangloi delhi-41. They did not give our salary after resignation, Before resignation period they force all the employee to do job without salary for 3 months ,if anyone not agree they said that they should give resignation,when we resignation to them on the month end of july ,they told that according to company policy we give salary after 45 days of resignation but till now they do not give any single panny. We even file a case in karampura labour court through rashtriya krantikaari majdoor union (reg. 4478) after filling the case union member told us that when labour inspector arrived in company he found that the company was closed, when we enqiue about company we found that on of its director open a new company name ,They even did before once hope you understand our problem.please give me best suggestion

Dear client !
You should immediately file a criminal case of fraud and cheating against the director who has opened a new company with the Nangloi Police Station. As regards salary, in the catena of judgments various high courts and even the apex court have held that unpaid salary of the employees is a debt towards the employees to be paid by the company or employer. Please take note of following -
Since you already have a pending case against the company in the Labour court and wherein it has been found that the company has been closed down by its owners, so now you should file a criminal case of fraud and cheating against the then directors of the company which has been closed down by them.
In prevailing situations this is the only way to get the solution for this problem.

will glad to help you. send him a notice through your lawyer and if it does not work out file a case for recovery of money before the district court. It will be a summery suit if they have accepted their liability for your undue amount.
