Case on Lease to vacate rented shop

Hi ! Lessee was not giving rent so I filed a case against him through a lawyer and he assured that it will be finalised within a year but it is been more than 2.5 years and we are getting only next date. It seems lawyer also not handling the case properly as he is missing so many dates. Please guide what to do? Regards Sachin Mittal

Such civil case are of such nature that they generally take time as litigation is a very lengthy process. However, it is advisable to engage another advocate for the purpose of same if the said advocate is not able to handle the situation by obtaining a NOC certificate from the previous advocate. However, if he refuses to give the “no-objection”, you may approach the court (where the case is pending) for permission to change your advocate, which is generally granted by the court, subject generally to your paying the (due or remaining) professional fee to the existing advocate if the advocate insists.
