Cancellation of registered deed of gift

12-Nov-2023 (In Civil Law)
I am hindu. I live in kolkata. My father lives in my native village. I have two brothers only. My father, now aged 83, a retired primary school teacher, made two registered gift deeds in my favour on 31.3.15 at R.A. III. Now all of a sudden on 10.8.16 he made a suit against me at Chuchura, Additional District Judge,Hoogly for Injunction and cancellation of deeds. He got Interim injunction against me, made allegation of confining him at my house for that period and its a scam. he also claimed i manufactured the deeds with the help of my advocate even though he returned native place after executing the deeds. He did not make any G.D./F.I.R against me till date. How can i win this case? Kindly provide your valued opinion.

it's a case of simple transfer & acceptance. Once it is gifted and accepted by u, it would b difficult for ur father to establish his confinement & force applied by u. For proper opinion some other relevant facts & information r required to be discussed in detail. plz. take proper legal steps to file written Objection & Statement at an early date. For further query plz. contact with details

Hi,
Your father can pray for cancellation on the grounds of force, coercion or undue influence. But he needs to prove his allegation against you to win the case. In this situation you need to contest it through your own lawyer.

MY OPINION THAT if you have the merits of contents in the first Deed of 31/03/15 in your behalf & the suit which your father filed against you and get injunction at Ld. District court , which is against your behalf , is contradictory, you have many ways to contest against that order, and get the merit of order on your behalf, contact with me.
