Cancellation of booking due to litigation

At the time of booking builder did not disclosed on litigation to his property. However my loan process bank ask to submitted required doc for legal process ,builder deny to produce and threatened me to sue from register office in Mumbai. Pls guide solution.

You can file an application in the concerned Consumer forum.
The builder cannot sell the disputed property to you.
How can the builder sue you please specify, theirs no fault on your part.
Instead you should file a complaint the Builder for the fraud done by him.

You have all the rights to cancel the booking. You also have the right to recover interest on the amount advanced by you. In addition you have the right to compensation for not revealing the truth, un-fair trade practice and you can file criminal case to punish the builder for breach of trust.

U can file a case against a builder as it is a civil matter so file a case and have a good lawyer who can help u out with this problem. And u can file a criminal case of sec 420 as he have done fraud with u.
