Dear Client,
State is sovereign. It has every right to take lands of anybody and use the same for public purpose and nobody has right to question the Royal The. Hence, to serve public purpose State with its Sovereign, supreme right can cut down trees for road extension. But the private owners who is going to effect by the action of state can take legal action against the state about the validity of action by way of filing Writ Petition in High Court of the concerned State, because it is an action of state interfering with property rights of individual subjects. My suggestion in this matter is concerned farmers should file a writ petition as soon as possible to stop the action of the State, if it vindicate it`s right arbitrarily and without rationale.

Hello,

National Green Tribunal (NGT) is not vested with powers to hear any matter relating to the Wildlife (Protection) Act, 1972, the Indian Forest Act, 1927 and various laws enacted by states relating to forests, tree preservation etc. Therefore, specific and substantial issues related to these laws cannot be raised before the National Green Tribunal (NGT). You will have to approach the State High Court or the Supreme Court through a Writ Petition (PIL) or file an Original Suit before an appropriate Civil court under whose jurisdiction the cutting down of tress in farmers land for road extension without any notice and illegally being carried out.
