Can one person appear in court on behalf of his family ?

Due to business loss, unsecured bank loan got NPA. Summons issued by bankshall court kolkata against case filed by bank in kolkata though i stay in mumbai. summons issued against myself and my wife, both partners in firm and also against my sister who is wrongly framed as guarantor by bank staff forging her signatures and also she is nowhere related to said firm. Can i appear on behalf of all three to take bail as travelling from mumbai to kolkata for all will be difficult. also we have small kids.

Infact, You need not appear personally before the Bankshall even. But i can be sure of this once I see under which sections, they have filed a case against you. I am currently dealing with such a case, where the client resides in Mumbai, proceedings initiated by a finance company in Kolkata. A petition u/s Sec 205 of the CrPC was filed and personal attendance was exempted. The whole thing can be done through phone and email. You need not worry.

If the court has summoned 3 individuals all three must be present either in person or through their representative. One needs to see the language of the summon to be able to clearly respond to that. two.

You must hire atleast two different advocates as the defence of your sister is different from that of your own.

I, think the Bank concern issued Summons for realization of the debt. it is purely a Money suit. No Bail is needed. However, you may kindly cheak the summons through nearest Ld. Lawyer at your present place first. thereafter proceed. once again I say that, it may not be Accused Summons. please cheak it.

MY OPINION THAT if the CMM court summon you, you should appear first time otherwise this court declared arrest warrant against the parties, the person against whom the summons are used they should appear at the concerned court to get bail, but there is so many ways to escape by law.

for bail physical presence is must and individual will have to be appear before court must and one person cannot appear for and on behalf of another in criminal case .thereafter u can apply before Ld. court for dispense with of personal attendance
