Can i file case of harassment against my grandfather

10-Jul-2023 (In Civil Law)
My 72 year old dad is acting highly erratic and has been harassing me constantly. The latest he did was send an affidavit to my child custody evaluator, saying I'm an unfit mom. He lives in Kerala and I don't. Is there any way I could file a case of harassment, and not attend any of the proceedings?

Of course you can lodge police complaint and if no positive response, you may approach judicial first class magistrate court having jurisdiction. Your query is vague regarding child custody. Anyway you are entitled for your child custody.

Hi there,
U can file a complaint against him before the police then in the court . But you will have to come here for giving statement other related proceedings. Your presence is not necessary always but on few occasions.
U said its ur dad, but want to file a case against grandfather for harassment. What kind of harassment is not mentioned. I would be better if you share that details also. Simply sending an affidavit wont b harassment at all..

Is it your father or your grandfather? The facts posted suggests that there are more material issues than that you have disclosed. Moreover, what is the stand of your husband? In the absence of complete facts, it may not be wise to make any suggestion.

Hai,
You must consider his age and the series of mental and physical status he going through. Seems like either he must be feeling lonely or must be a pensioner from a highly social job. I strongly suggest you not to initiate any proceedings against him. yet if he starts some do defend it. Bare in mind no child is born with a bad mother or as like her said unfit mother. so dont yell on that n dont waste much time on it. Some may find it intimidating and annoying but bare in mind the situation he too will be going through, Also u have too many legal remedies to take for the protection of ur kid n against his deeds.

Hope am upto your query
