Can applicant and guardian of minor be same person in succession cert

While obtaining the succession certificate u/s 372 of India succession act can applicant and the guardian of minor in opposite party be the same person ? Is this suit will be allowed or not ? Asking this question because judge is saying that is not maintainable giving reason that the both are the same party....
The same can be allowed by giving reference to the cases mentioned below:
