Can a owner of an unapproved flat can take the tenants to court

The landlord, an owner of an unapproved flat has taken me to court for eviction without wilingness to pay my deposit back. Can the landlord approach the courts in this regard.. Thanks Narayan

Whether the flat is approved or unapproved he can file a petition for eviction if he can prove that he is the Landlord. On what grounds has he filed foe Eviction? He has to return your deposit amount or you are entitled to adjust the advance amount with the rent. Also he cannot take more than one month rent as advance as per the latest rule. The Owner of the Property have the power to vacate his client on the basis of the title deeds and local revenue records stands in his name not respective of the approved flat or not.You may file suit for recovery of deposit amount against the landlord before the concerned civil court.

Yes he can, it is up to him to make out a case and you are suppose to defend the same with necessary evidence and witness, without going into content of plaint it is difficult to give opinion on the same.
