Can a lady staying separate not divorced volunteer for surrogacy

If an adult female is separated from her husband but not divorced....can she volunteer as a surrogate mother ? Instead of her husband can her mother act as her guardian and sign the agreement for gestational surrogacy ?
No, it is not possible. Even if she is separated from her husband, still she is a married person and not divorcee. She cannot volunteer as a surrogate mother without the consent of the husband. Now, the law regarding surrogacy has undergone a change. Commercialisation of the surrogacy has been prohibited. So long as husband is not divorced or is alive, he cannot be ignored and his status is statutory.
