Business partner of father not giving father's share after his death

My father had real estate business after his death his partner is not giving his share.to prove or claim our money we have cheques,hand written amounts of my father in his diary and some witnesses,are these evidences enough to get a 420 case registered against the partner.

Rather to file a 420!case you can file a complaint of 138 negotiable instrument act based on cheque dishonouring . You can also file civil suit of rendition of accounts or suit for recovery against the other partner .
