Broken engagement, legal notice with false claims sent, what to do?
23-Jun-2023 (In Civil Law)
We had received a Matrimonial alliance for our son from Hasanpur in the month of April mediator from our side is my father’s cousin whereas from girl it was her brother in law. The engagement ceremony was done on 7th may 2017 at girls house. Next day the girl's mother fought with my mom accusing her that we did not give ornaments and cash to girl ,to that my responded that we are not able to fulfil your demands, due to fearing problems in future ,after Marriage is solemnised we cancelled the Marriage by breaking the engagement and same has been communicated to the mediators on the same day. Girl brother in law continuously threaten us that you have to marry either we will file FIR take you to court even use abusive language to my parents. Now they have send legal notice asking for money that they have booked banquet hall, tent wala ,caterer etc. they also mentioned that we had demand a car , gold and ash but we never asked for. Can you please advise what action to take. Thanks
The legal notice contains accusations that you demanded dowry. As per law, the opposite party is required to prove that you asked for the same, if they are unable to prove the same which they will be, as you have not asked for the same. Also, you can contest the case (If they filed) on the grounds that they had unreasonable demands which you were unable to fulfill and the said marriage was not yet solemnized which means you share no liability as you have not committed any kind of fraud in respect of this particular incident.
