Let your boss issue notice to pay which is due from you. Then you may pray for time or installment facility. You have not disclosed whether your's company is MNC or Indian Company. If it is MNC you have not options and voice. But if it is Indian Company you have several options.

your query does not make clear as to what kind of case is filed and what is the offence. please know that it is the trust between master and servant that make the business flourish.
The amount you have taken is advance. It is to be returned promptly. If you are entitled to any amount, you can claim. You cannot deduct from advance and pay the balance, unless your boss agree for the same.
Get settle case by speaking to your boss, who is your paying master.
Have advise from the Advocate, who is practicing law on Labour Laws. Good Luck.

Sir,
In your case you have admitted that you have taken advance amount. Now once the case is filed, the court has to decide to deduct the amount. Here in court your should mention that how much increment that your primrosed to receive from the company.

Please don't take decision by your own.

With regard to the penalty it is the discretionary power of the court. .
