Booked a marriage hall not refunding money after cancellation

Hi, I had booked a banquet hall for my sister marriage on 12th April 2016 ,but her fiancee' elder brother expired on 1st April 2016 because of which the marriage was postponed. I had paid 30000 cash as advance and gave a cheque of rs 1.30 lakhs to the banquet hall. On requesting cancellation they are ready to refund only rs 50000 stating that no other marriage took place that day. Also, if we don't take the refund he is telling he will adjust 80000 if we use his hall before 28th Feb 2017. And he will be charging a much higher price per plate this time We are in a fix as we belong to a middle class family. Kindly advise what should we do.

You may file complaint in police station .and give legal notice to owner of the banquet hall .still if he didn't ready to refund your money than file case in consumer court or civil court .but first give leagal notice and complain

As per contract act there are certain agreement which get frustrated due to contingency ,the provision is provided in the act now we had to see the terms and conditions of the guest house ,with that the agreement made by you ,after that it's possible to give you exact advice ,but it's hopeful !!

Please go to nearest police station and logged first information report opposite party above party and refund your deposit 30000 thousand rupees and sattelment your problem& I agree police your fully support.
