Bank mortgaging the common registry without itimating the other party
17-May-2023 (In Civil Law)
We have a common registry with our uncle & having rule of court defining both of ours divided portion with map. Now somehow our uncle took a loan of almost 1 cr from private bank by keeping that commom registry on his portion as mortgage without imtimating us . Now few yrs later we required some banking financial assistance & hence asked fr registry & my uncle told to get dat from their bank & somehow we agreed on dat . Now after few yrs we are planing to sell our property & hence want to close that loan account but bank is not releasing that registry as they says unless & untill both accounts are closed we will not release the registry. In my uncle' loan a/c we are not coapplicants & not even gurantor... but in our loan a/c he is coapplicant.. want to know while taking a registry bank doesnot requires NOC or coapplicant as all the names mention in the registry .. . kindly guide us please
It is important to take NOC before bank takes tha registry.
Please find out that how they accepted the registry paper without NOC
Which bank is it ?
Bank will not give the registry back untill the A/c are clear.
Go throught tha contact your uncle had with the bank when Mortgage that registry.
