Appear in Person in District court for civil case

I Can not afford to engage new lawyer. i have already changed two lawyers in my case. first was not good and second was demanding too much money. my case is pending in district court pune. and my lawyer refused to fight my case suddenly. please suggest me what i can do. I want to fight my case by own. and what is procedure required to do so.... and please give format of form for appear in person.

Legally you have every right to appear in person but you should know how to conduct the matter yourself, which you do not know. Hence you have to either engage some lawyer or approach Legal Srvices Authority in Pune. Moreover all depends upon the type of case too.

if an advocate has filed a vakalatnama for you it his duty to attend and argue at the trials and he cannot back off for the want of more money or fees there is a case law for that. You can present you own case to the court but as you are a citizen who is not an advocate you will not have the requisite knowledge of law it will definitely become troublesome for you and the court. also there is a legal aid cell which provides lawyers free of cost.

To fight case in Pune is not so easy without lawyer.
court. is it true?? because citation have all details of case in it's print. Please tell me how i can submit it in court....??? Case is for argument and i have decided to 'appear in person' in court. My case is civil matter and in district court Pune.

Hello!

Very unpleasant your situation! But then you said you want to fight your own case.

There is no compulsion in law for any citizen to engage a lawyer to fight his / her case in the court. People engage Advocate because he is an expert in laws and legal procedure, just like the judge. Therefore as far as training in laws and legal procedure is concerned, they are on same platform. It makes easier and smoother for a judge and a lawyer to work out the case, as compared to a situation in which the litigant is appearing in person. It is just like two persons knowing very little of each others' language and trying to understand each other. Imagine how cumbersome it would be. Sometimes courts frown upon such litigants in person, if they do not at all understand anything, and go wayward.

But then there ARE people who fight their own cases. They have to spare time for courts and their cases. They learn and understand the procedure applicable to their cases, and the laws involved in it. Its not very easy, and of course, they lack finesse of a trained lawyer, but they manage it somehow.

I do not think there is any format for appearing in person. You just start appearing and conducting your case. It is advisable to keep seeking counsel from some lawyer at the background.
