Action against online shopping portal in order to get money refund

I returned a smartphone to XX as confirmed by them after finding defect in it. They told me that I will receive my refund money after it is returned.So I sent it through INDIA SPEED POST and tracked it.When I came to know by tracking that the item is received,I asked them for refund.But they told that they have received an empty box and will not refund my money of Rs 8998.I stated the whole incident and gave a letter, demanding investigation to the Post master in my source Post office.The Post master also told me that why did the XX person received the item if they found it to be an empty box.Meanwhile at first XX customer care told that they received an "EMPTY BOX" in their ware house.After escalating to customer executive,he mentioned that the ware house didn't receive my item.Now the question arises from XX's end also, as their clarification is not proper and shows that they have some issue from their end specially the ware house area.What action should be taken?

You have to have evidence of all the transactions such emails, your order, your request for rectification or service, their denial, warranty certificate if applicable , payment proof etc. You have to find the address of Consumer Forum in your region. Usually these will be listed in Government sites. Then you have to a make formal complaint with the complete history of the case and proof for service deficiency. The forum may stipulate some fee as applicable. You may also send the copy of your complaint to the company that you are complaining about. The Consumer Forum would examine the merit of the case based on the evidence and proof and if they are convinced , they would send a summon to the company to appear from them to present their version. The forum would give the verdict if there is merit in your case. You can pursue the matter on your own in consumer forum and if you want our help than you need to contact us through Lawrato. At first you cheak it that, when your send ITEM through Post Office, weight was taken by the office after collect amount from you and it is the evidence that, you did not send the Box in empty position. Now you should collect information regarding the exact weight of said item, which you send through Post.
Now you have enough evidence regarding box which you send to the address, who stated that, the box was empty. Lastly file a complaint before the Consumer Forum in your District against both the Post Office and said Concern who denied to receive items. and additionally claim refund award with interest.
