Who gets the custody of a 6 year old boy before any legal separation.

I am planning to get separated from my husband. I know my husband will not divorce me. I would like to know who gets the legal custody of a 6 year old boy without any beginning of legal process. The mother of the child is working from home, earns a decent salary and takes care of the child. The father works from 9-9 and hardly gets time to spend with child. I also know that my husband can go till any extent for the child custody. What would be the right steps to get legal custody of the child without any legal seperation.
Custody of a child at a tender age of 6 years is usually given to the mother considering the interest of the child. In your case, the likelihood of custody given to you are higher as you are working from home and will be able to take care of the child.
