Me and my husband separated, he is blackmailing me with some of my proofs at that basis he has taken my child, what should i do to get child custody, we are separated not filed any case as yet

You may seek legal remedy if he is blackmailing you. You may file a complaint in police station having jurisdiction. If the child is below five years of age you may get it through court. A meertng in this regard can be done for further details.

You should take legal action by filing for divorce . If he is blackmailing you ,you should collect them as evidence against him by recording whatever he says or preserving any other proof written or oral and legitimately fight for child's custody.

you should immediately file a petition under Guardianship and Wards Act seeking custody of the child. You can also file a writ of habeas corpus saying that he has forcibly taken custody of the child from you. Do not worry, unless there is an order of the court he cannot take away the custody of a minor child from you. Immediately prefer a petition in court.

You can file a case of maintenence and also file for child custody. Whereas the matter of proof on which basis he is blackmailing it is the matter of concern which type of proof.

you require to file a child custody petition under Guardians and Wards Act. the sole paramount consideration in child custody decisions is welfare of the child. though both the parents are natural guardians of a child, if the child is below 5 years of age, the custody should ordinarily be with the mother. there are a plethora of cases wherein the court has favored the custody of the child with mothers but the end determining factor is the welfare of the child.
