Need NOC from divorced husband for custody of child

The couple got seprated through a legal divorce, the divorce decree recognizes the fact the husband will not give any maintainance and would not have any claim rights on the child. However the demand for a legal sole custody right letter/ certifcate comes up repeatedly from School, visa offices etc. My question is - how does the court grant a custody letter to the mother espeically when the ex- husband is not giving the NOC. There has been no maintainance nor any association ever since the seperation happened in 2009.

You will have to show the divorce settlement deed to the authorities, if the same exists. The mention of child custody in your name must be there in the deed. But in case the authorities are not satisfied with the same you will have to file the case for claiming custody of the child separately.

You can reveal the divorce judgment /decree to any authority or office with regard to the custody of your child.If your husband has agreed towards the custody of the child and judgement is revealing that fact remaining with mother than any authority or office shall not have any objection with regard to the sole custody letter,however most of the people outside the court have limited knowledge about the legal language,therefore you can always write a letter to them highlighting the custody part in your favour then there should not be any issue and you are not required to collect any no objection certificate from your husband when Court has already granted judgement and decree with regard to the custody in your favour.

You can apply for the certified copy of the court order which states that husband would not claim any right on the child. This copy you can give to school or any authorities to state that you have the sole custody of your child. Thank you.
