How to get custody of child after divorce

My cousin sister wants Divorse from her husband as he used to beat and abuse her. She had filed a police complaint against him 1 week ago. And her father have taken her daughter and has sent it to his brother in delhi. How can we take her daughter back with us. Plz help. They are basically from Amritsar and the lady is now in Jalandhar and duahgter is in Delhi with her uncle and aunt

You can file complaint with police if child is in iilegal custody.even you can file case in court for custody of child with interim application of visitation rights.if you want to know more pl call me

File police complaint and in case police does not help then file petition before court need not to worry for more details you may contact via law rato.she can file divorce and also can get maintenance.

dear Friend, In the question you have not mentioned about the girl child of your cousin sister, Anyways, Since your cousin is residing in Jallandhar , she can file a case seeking the custody of the child against her husband. She should also file a petition seeking divorce from her husband, on the basis of the cruelty and other relevant grounds. She can get the custody of the child on the basis of the ground that the father does not have affection for the child and has sent the child to Delhi.
