How can I claim child custody

I am Christian married to a Hindu man. Our marriage was not legally registered it was a arya samaj mandir marriage. We have a son who is 6years old now. We both have headed towards divorce due to misunderstanding and his family have not accepted me as their daughter in law. Now the child is with me . I am taking care of his everything. I just wish to enquire what may be due result. I am working and earning more than him and I don't want any maintenance for my son from him. I just want my son as he is a drunkard and a chain smoker too. But am really scared about doing result.

Denying child custody or visitation rights to husband is very difficult. Such harsh judgment is given by the courts only in extreme situations. You can convince the court that the husband is a bad influence to the child or is of a bad moral character or a habitual drinker etc. and after that its up to the court's discretion to deny the visitation rights or not.
